PAYMENTS:
If the BUYER, having put a deposit on a puppy, should later change
their mind about the purchase, the deposit will not be refunded.
The remaining balance amount must be paid in full no later than the
agreed date of purchase or the SELLER may at their discretion void the
contract and retain the deposit. If for any reason, the puppy should
die or suffer a debilitating injury or illness before the transfer
of ownership, another puppy of comparable value can be chosen as a
replacement.
SELLER GUARANTEES:
The SELLER provides a 7 day limited warranty guarantee that the
above described puppy is in good health at the time of purchase. Vet
exam with health cert. will accompany to verify at request for a
cost of $25. Any puppy will be
sold healthy to the best of our ability to ascertain. In order to
validate the health warranty, the BUYER must take the puppy to a
licensed veterinarian within 48 hours upon transfer of ownership,
excluding holidays and weekends, at the BUYER'S expense. The BUYER
must notify the SELLER of any claim under the warranty immediately.
The SELLER must authorize any necessary treatment or other
expenses.
SELLER IS
NOT RESPONSIBLE FOR ANY VETERINARIAN BILLS INCURRED BY THE BUYER.
If the veterinarian finds the above puppy to have a life-threatening
illness or defect, he/she should write and sign a short note on
his/her letterhead stationary explaining his/her findings. The
puppy may be returned to the SELLER within seven days for exchange
of a new puppy. If no replacement is available at the time of
return, the SELLER will have up to 1 year to furnish a comparable
puppy. The puppy cannot be returned for compensation after the
guarantee period has expired. SELLER will not honor any health
guarantee if the puppy dies of a canine virus after the initial 7
day limited warranty period. It is highly recommended that the
above puppy be quarantined until the initial veterinarian exam has
been performed. Under NO circumstances is the puppy allowed to be
"destroyed" prior to notification of the SELLER.
If the puppy described above should be diagnosed with a
life-threatening
CONGENITAL
or hereditary defect, by a licensed veterinarian, UNTIL THE PUPPY'S
FIRST BIRTHDAY, the SELLER will replace the puppy with another puppy
of equal value UPON THE RETURN OF THE ORIGINAL ABOVE MENTIONED
PUPPY. Written proof must be provided to the SELLER by the
diagnosing veterinarian. The SELLER reserves the right to provide a
cash refund.
If the puppy should die due to a CONGENITAL or hereditary defect
WITHIN THE 1 YEAR genetic period, the SELLER will replace the puppy
with another puppy of equal value at no cost to the BUYER within a
timely manner. The SELLER must receive proof in the form of a
COMPLETE AUTOPSY REPORT
completed by a licensed veterinarian and performed at the BUYER'S
expense--STATING CAUSE OF DEATH. The SELLER reserves the right to
provide a cash refund. BUYER is responsible for shipping on the
replacement puppy, not to exceed $150 USD.
The SELLER will have completed all of the age-appropriate
vaccinations, de-worming and medical examining prior to the transfer
of ownership. The SELLER will not warranty the puppy against any
adverse reactions to future vaccinations or hospital stays due to
airplane stress. If the BUYER is purchasing a tiny, delicate dog,
it is recommended that he/she pick up the pup as opposed to
shipping.
BUYER Obligations
BUYER accepts the responsibility of caring for the puppy and will
provide properly for it's welfare. BUYER agrees to keep the puppy
indoor at all times in a clean and pleasant environment with proper
nutrition and health care. BUYER understands that if the puppy is
found to be neglected or mistreated in any way, SELLER shall have
the unconditional right to reclaim the above puppy without refund of
the purchase price. Neglect shall include, but is not limited to:
lack of proper sanitary facilities, providing poor diet, and poor
health. Mistreatment shall include, but is not limited to: lack of
food, lack of proper medical care, and any form of physical abuse.
BUYER shall be responsible for any veterinary bills directly
incurred as a result of any neglect or mistreatment.
NOT COVERED:
SELLER IS NOT
responsible for death or illness due to hypoglycemia or sugar drop!
It is the responsibility of the BUYER to ensure proper nutrition and
care of the new puppy. We will provide you with proper instructions
on keeping your tiny healthy, if the dog is the slightest bit
ill--IT IS TO BE TAKEN TO THE VET IMMEDIATELY. DO not try to treat
the condition yourself, you will only end up acquiring more medical
bills by letting the condition get more critical, and are at great
danger of loosing your puppy. NOTE: constant supervision is to be
given to micro-tinies until at least 6 months of age!!
Any legal action which may arise under the terms of this contract
will be brought in Newton NC. In signing this document, BUYER
acknowledges that he/she has read, fully understands, and agrees to
ALL of the terms and conditions stated above. The laws of the state
of NC shall be controlling.
